ELIGIBILITY: “What Taste Buds Crave” Sweepstakes (the “Sweepstakes”) is only open to legal residents of the U.S. (excluding Puerto Rico), who are 18 years of age or older as of May 20, 2008. Employees of Cargill Meat Solutions Corporation (the “Sponsor”), Associated Advertising Agency Inc., Don Jagoda Associates, Inc., their respective parent companies, subsidiaries, affiliates, directors, officers, employees, agencies, nor any of their respective partners (collectively, the “Sponsor Affiliates”), or any of the members of their immediate family (defined as spouse, mother, father, in-laws, grandmother, grandfather, brother, sister, children and grandchildren) or same household of each are not eligible to participate. Sponsor reserves the right to verify to its satisfaction, the eligibility of any entrant. This Sweepstakes is void in Puerto Rico and where prohibited or restricted by law and is subject to all applicable federal, state and local laws. HOW TO ENTER: To enter the Sweepstakes, beginning 12:00:01 AM EDT May 20, 2008 and ending 11:59:59 PM EDT August 15, 2008 (“Sweepstakes Period”) entrants may visit the Sweepstakes website at www.meetyourtastebuds.com and complete an online entry form, including all requested information. Online entries must be received by 11:59:59 PM EDT each day during the Sweepstakes Period to be eligible for that day’s drawing and all subsequent days’ drawings, if any. Entries will be carried forward for subsequent days’ drawings, if any. Online entries must be received by 11:59:59 PM EDT August 15, 2008 and must be complete in order to be eligible. Online entries generated by script, macro or other automated means are void. Normal Internet access and usage charges imposed by entrants’ online service will apply. Neither the Sponsor nor the Sponsor Affiliates assume any responsibility for incorrect or inaccurate capture of entry information, including, but not limited to, technical malfunctions, human or technical error, printing errors, lost/delayed/garbled data or transmissions, omission, interruption, deletion, defect or failures of any telephone or computer line or network, computer equipment, software or any combination thereof. Limit one online entry per person/email address per day. PRIZES AND APPROXIMATE RETAIL VALUE (“ARV”). Four hundred forty (440) Prizes {five (5) per day}: A Taste Buds chef's hat (ARV $20 each). Total ARV of all Prizes is $8,800. The Sponsor reserves the right to substitute the prize with a prize of comparable or greater value if the prize cannot be awarded as described for any reason. RANDOM DRAWINGS: There will be five daily winners randomly selected for each day during the Sweepstakes Period, from among all eligible entries received by the end of each day. The drawings will be conducted by Dogwood Productions, Inc., whose decisions are final and binding on all matters related to this Sweepstakes. Odds of winning are dependent upon the number of eligible online entries received by the end of each day. WINNERS’ NOTIFICATION/VERIFICATION: The Prize winners will be notified by mail. Winners will receive their prizes within 6-8 weeks after winner selection. If any prize/prize notification is returned as undeliverable, such prize will be forfeited, and an alternate winner will be selected. All winners are responsible for any and all federal, state and local taxes that may apply. LIMITATIONS OF LIABILITY: Neither Sponsor nor its agencies are responsible for lost, interrupted or unavailable satellite, network, server, Internet Service Provider (ISP), website, telephone or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, corrupted, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures, technical errors or difficulties, or other errors of any kind whether human, mechanical, electronic or network or the incorrect or inaccurate capture of entry or other information or the failure to capture any such information. Neither Sponsor nor its agencies are responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the website. Neither Sponsor nor its agencies are responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes, and assumes no responsibility for any error, interruption, deletion, defect, delay in operation, or transmission, communications line failure, theft or destruction, or unauthorized use to this website. If for any reason, the Sweepstakes is not capable of running as planned by reason of infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures or any other causes beyond the control of Sponsor, which in the sole opinion of Sponsor, corrupts or affects the administration, security, fairness, integrity or proper conduct of the online component of this Sweepstakes, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Sweepstakes and select the winners from eligible online entries received prior to and/or after (as appropriate) the action taken by Sponsor or by such method as may be deemed fair and appropriate by Sponsor. Sponsor reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or web site. In the event of a dispute as to ownership of online entries submitted by multiple users having the same email account, the authorized subscriber of the email account used to enter the Sweepstakes at the actual time of entry will be deemed to be the entrant and must comply with these Official Rules. The authorized account subscriber is deemed to be the natural person who is assigned an email address by an Internet access provider, online service provider or other organization, which is responsible for assigning email addresses or the domain associated with the submitted email address. DISPUTES: Each participant agrees that: (1) any and all disputes, claims, and causes of action arising out of or in connection with this Sweepstakes, or any prize awarded, shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court within the State of Kansas; (2) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will a participant be permitted to obtain awards for, and each participant hereby waives all rights to claim punitive, incidental, or consequential damages, any other damages other than actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.
